CITIZEN’S TASK FORCE FOR PROPERTY MAINTENANCE

REGULAR MEETING AGENDA

6:30 P.M.

 

1.         ROLL CALL.  Mr. Smith called the meeting to order with roll call as follows:  Mr. Barletta, Mr. Smith, Ms Goodrich, Ms Carter, Mr. Sells, Dr. Henry, Mr. Bowen, Mr. Walburn, and Ms Trout were present.  Mr. King was absent.  Others present were:  Mayor Shaver, Judy Gilleland, Lance Schultz, Lynda Yartin, George Parsley, and others. 

 

2.         APPROVAL OF MINUTES OF April 7, 2005, Regular Meeting.  Ms Goodrich moved to approve; Ms Carter seconded the motion.  There being no discussion Roll call was taken with Mr. Sells, Ms Goodrich, Dr. Henry, Mr. Walburn, Ms Trout, Mr. Bowen, Mr. Smith, Mr. Barletta, and Ms Carter voting “Yea.”  Motion passed,  9-0.

 

Mr. Smith stated several members of the Task Force attended the Safety Committee this month where two of the Task Force’s recommendations were considered, on street and off street parking, and home occupations.  Ms Carter stated Safety Committee had requested semi’s be specifically included when referencing large vehicles.  Mr. Smith stated there were some minor changes recommended by Safety Committee and those would be incorporated into legislation that would be considered at the June Safety Committee meeting.  Mr. Smith stated the home occupations legislation had incorporated what Safety requested at their last meeting, however, there were some questions regarding the exemptions from needing a Certificate of Zoning Compliance.  Mr. Smith stated he felt the Task Force’s intent was clear, and once that is clarified he felt Safety Committee would accept the home occupation legislation.  Mr. Smith stated he thought Safety might like some of the Task Force members to attend the next Safety Committee to answer any questions regarding the on and off street parking legislation. 

 

3.         SCHEDULED MATTERS.

 

A.        Review of House Maintenance Standards recommendations by Task Force members. 

 

(1)        Structural Damage

(2)        Paint

(3)        Roofs

(4)        Fences

(5)        Landscape Weeds

 

Mr. Bowen stated he had provided proposed revisions to the Task Force members regarding house maintenance standards.  He stated he had not added a lot of new things, but rather he had elaborated on what we do have to clean up some of the grey areas.  Mr. Smith clarified Mr. Bowen had used the International Property Maintenance Code as a model when doing his research.  All Task Force members stated they felt the proposed revisions were very complete.  Mr. Bowen stated one advantage to using the International Property Maintenance Code as a model was that it has been reviewed by many individuals, including attorneys, before it was published. 

 

The Task Force discussed the structural requirements, Section 1490.12, that had been provided and recommended some revisions regarding screens, decks, and railings.  Mr. Schultz stated he would ensure all of the recommended revisions were incorporated into the draft legislation.  Ms Carter moved to forward to Safety Committee the draft legislation incorporating the revisions recommended by the Task Force this evening; Ms Goodrich seconded the motion.  Roll call was taken with Mr. Walburn, Ms Carter, Mr. Smith, Mr. Sells, Ms Trout, Mr. Barletta, Ms Goodrich, Dr. Henry, and Mr. Bowen voting “Yea.”  Motion passed, 9-0. 

 

The Task Force discussed the draft revisions for Noxious Weeds, Section 680.01.  Ms Trout stated the draft provided was created using sources from the City of Dublin, Miami Township, Lakewood, Ohio, and our current Code.  She stated she had tried to address where we have problems and the problems we have in enforcing our Code.  Mr. Schultz stated there are some exceptions, such as detention ponds, where the City requires grass that grows high and has wild flowers.  Mr. Smith stated if the wording was changed to remove the statement “all categories of grasses,” that would allow for the exception needed.  After further discussion, Ms Carter moved to forward to Safety Committee the draft legislation incorporating the revisions recommended by the Task Force this evening; Mr. Barletta seconded the motion.  Roll call was taken with Mr. Walburn, Ms Carter, Mr. Barletta, Dr. Henry, Mr. Bowen, Ms Goodrich, Mr. Smith, Mr. Sells, and Ms Trout voting “Yea.”  Motion passed, 9-0.  

 

Mr. Schultz stated the proposed changes recommended for Nuisance Vegetation; Growths Over Sidewalks would have to be reviewed by the City Attorney as it does fall into several different areas of our Code. 

 

Mrs. Yartin stated once she receives the draft legislation, a copy will be provided to all Task Force members for their review. 

 

 4.        OTHER BUSINESS.  Mr. Smith stated with the recommendations made this evening, the Task Force has completed review of the sections they were initially tasked to address.  He stated the next meeting would be at the call of the City Manager and would not be before September.  Mr. Schultz stated he would keep the Task Force members informed as to the status of the legislation proposed this evening.   

 

5.         ADJOURNMENT.  There being nothing further, Ms Goodrich moved to adjourn; Ms Carter seconded the motion.  Mr. Sells, Mr. Smith, Ms Goodrich, Ms Carter, Dr. Henry, Mr. Walburn, Ms Trout, Mr. Bowen, and Mr. Barletta voted “Aye.”  Motion passed, 9-0.  The Property Maintenance Task Force adjourned at 8:35 P.M., May 5, 2005.
