  1. ROLL CALL: Mr. Linek called the meeting to order at 7:00 P.M., with roll call as follows: Mr. Linek, Mr. Wells, Mr. Boruszewski, and Mr. Wells were present. Mr. Cline was absent. Others present were Lance Schultz, Dawn Romine, Joe Henderson, and Richard Cherry.

 

  1. APPROVAL OF MINUTES OF October 27, 2005 Regular Meeting: Mr. Boruszewski moved to approve: Mr. Wells seconded the motion. Roll was taken: Mr. Linek, Mr. Wells, Mr. Boruszewski, and Mr. Wright voted “Aye”. Motion carried 4-0

 

  1. SCHEDULED MATTERS

 

A.     Review and request for a motion to approve a rear yard setback variance for a deck at 665 Manchester Circle North (Manchester Subdivision).

 

Mr. Schultz stated Zoning History: None. Proposed Use: The owner is proposing to construct a 13-ft x 16-ft (208 square feet) wood deck and an adjacent 13-ft x 13-ft (169 square feet) paver patio that would be located on the rear of the house. Variance Request: Chapter 1276.09 – Required Site and Building Dimensions – In a R-4 district the rear yard setback is 35-ft. The proposed deck and patio would be located approximately 19-ft from the rear property line to the south. It protrudes approximately 16-ft into the rear setback. The property is surrounded by residential properties and would likely impact the properties to the south the most. Staff supports the deck if the adjacent residents do not have a legitimate compliant because it protrudes only 16-ft into the setback and the BZA has approved similar requests in the past. The subdivision has several houses with large decks and the proposal would not be out of character for this subdivision. Staff Recommendation: Staff supports the rear yard setback variance request for the deck with the following condition: That the rear setback for the deck shall be reduced from 35-ft to19-ft. An approved zoning certificate is required prior to submission for building permits.

 

Mr. Wright did state that this is a shame that there are so many lots that where platted with no room for the owner to be able to enjoy their property and add decks. That the only way to be able to do this is come to the Board of Zoning Appeals asking for a variance. Hopefully in the future all new developments will be platted with large enough lots that there will be no need for property owners to apply for a variance.

 

Mr. Wells moved to approve: Mr. Wright seconded the motion. Roll was taken: Mr. Linek, Mr. Wells, Mr. Boruszewski, and Mr. Wright voted “Aye”. Motion carried 4-0.

 

  1. OTHER BUSINESS: Next meeting would be January 26, 2006 if there is an agenda.

 

  1. ADJOURNMENT: There being nothing further. Mr. Wells moved to adjourn; Mr. Wright seconded the motion. Roll was taken: Mr. Linek, Mr. Wells, Mr. Boruszewski, and Mr. Wright voted “Aye”. Motion carried 4-0. The Board of Zoning Appeals meeting adjourned at 7:05 P.M., December 22, 2005.
