1. ROLL CALL, PLEDGE OF ALLEGIANCE, AND INVOCATION. Council for the City of Pickerington met for a regular session Tuesday, November 21, 2006, at City Hall. Mr. Wisniewski called the meeting to order at 7:30 P.M. Roll call was taken as follows: Mr. Fix, Mr. Hackworth, Mr. Smith, Mrs. Hammond, Mr. Wisniewski, and Mr. Sabatino were present. Mayor Shaver arrived at 7:55 P.M. Mrs. Riggs was absent. Mr. Wisniewski stated Mayor Shaver was not present due to a family obligation. Others present were: Judy Gilleland, Lynda Yartin, Linda Fersch, Phil Hartmann, Chief Michael Taylor, Ed Drobina, Lance Schultz, Rex Myer, Whitney Wilson Coy, Ted Cassady, Bryan McFerin, Gene Eisly, David Owen, Greg Wilder, Lyn Fallswell, Dave Dozer, Kirk Richards, Pastor Eric Cuenin, Harry Myer, Bruce Englehart, Ed Laramee, and others. Pastor Cuenin delivered the invocation.
2. A. APPROVAL OF MINUTES OF October 17, 2006, COUNCIL RETREAT. Mr. Smith moved to approve; Mr. Wisniewski seconded the motion. Roll call was taken with Mr. Sabatino voting “Nay,” and Mrs. Hammond, Mr. Wisniewski, Mr. Smith, Mr. Hackworth, and Mr. Fix voting “Yea.” Motion passed, 5-1.
B. APPROVAL OF MINUTES OF OCTOBER 24, 2006, WORK SESSION REGARDING DISCUSSION ON ECONOMIC DEVELOPMENT AGREEMENT. Mr. Smith moved to approve; Mrs. Hammond seconded the motion. Roll call was taken with Mr. Sabatino, Mr. Smith, Mr. Fix, Mr. Hackworth, Mrs. Hammond, and Mr. Wisniewski voting “Yea.” Motion passed, 6-0.
C. APPROVAL OF MINUTES OF OCTOBER 24, 2006, REGULAR MEETING. Mr. Smith moved to approve; Mr. Wisniewski seconded the motion. Roll call was taken with Mr. Wisniewski, Mr. Hackworth, Mrs. Hammond, Mr. Smith, Mr. Fix, and Mr. Sabatino voting “Yea.” Motion passed, 6-0.
D. APPROVAL OF MINUTES OF NOVEMBER 2, 2006, WORK SESSION REGARDING DISCUSSON ON ECONOMIC DEVELOPMENT AGREEMENT. Mr. Sabatino moved to approve; Mr. Hackworth seconded the motion. Roll call was taken with Mr. Sabatino, Mr. Hackworth, Mr. Fix, Mr. Smith, Mrs. Hammond, and Mr. Wisniewski voting “Yea.” Motion passed, 6-0.
3. APPROVAL OF AGENDA. Mr. Smith moved to approve; Mrs. Hammond seconded the motion. Roll call was taken with Mr. Fix, Mr. Smith, Mrs. Hammond, Mr. Hackworth, Mr. Sabatino, and Mr. Wisniewski voting “Yea.” Motion passed, 6-0.
Mr. Wisniewski stated Mr. Greg Wilder who is the Central Ohio Region Liaison for Auditor of State Betty Montgomery, was present this evening to present an award to the City. Mr. Wilder stated he was presenting an award for the 2004 Fiscal Year Audit for the City of Pickerington. He stated it is a very difficult award to achieve, and approximately five percent of the 5,000 entities audited annually receive this award.
4. COMMUNITY COMMENTS:
A. Mr. Rex Myer, 261 Pearl Lane. Mr. Myer stated he had recently attended a meeting in a town in Florida. He stated at that meeting the speaker had spoken about a town in Ohio that knew how to get the voters out to vote, and she was referring to Pickerington.
5. APPROVAL OF CONSENT AGENDA: Mr. Wisniewski stated there were no Consent Agenda items this evening.
6. COMMITTEE REPORTS:
A. FINANCE COMMITTEE. Mr. Wisniewski stated Finance had met on November 16th, and some items on tonight’s agenda came out of that meeting. Mr. Wisniewski stated Finance Committee, as well as all of Council, have been working on the budget and he would like to thank everyone for their hard work.
B. RULES COMMITTEE. Mr. Fix stated Rules Committee met on November 6th, and the minutes have not been distributed as yet.
C. SAFETY COMMITTEE. Mr. Smith stated Safety Committee met on November 6th, and the ordinance to adopt the Parks Master Plan came out of that meeting.
D. SERVICE COMMITTEE. Mr. Hackworth stated Service Committee met on November 9th, and several items on tonight’s agenda came from that meeting. Mr. Hackworth stated that Item 8.G., Ordinance 2006-117, was removed from the agenda as it was a duplicate ordinance. He stated the remainder of the ordinances were to approve the appropriation of property that the property owners have agreed to; and ordinances to begin the eminent domain action on properties where agreements have not been reached. He stated we are continuing to negotiate with the property owners to try and reach an agreement if at all possible.
7. REPORTS:
A. MAYOR. Mr. Wisniewski stated the monthly Mayor’s Court Report has been distributed and he had nothing further to report from the Mayor’s office this evening.
B. LAW DIRECTOR. Mr. Hartmann stated with regard to the property acquisition legislation, as Mr. Hackworth stated some of the ordinances establish a settlement with the landowner and the remainder authorize his office to begin appropriation proceedings. He stated that will not begin until additional negotiations conclude.
C. FINANCE DIRECTOR. Mrs. Fersch stated she would request three readings on the appropriation ordinance on tonight’s agenda, and she would request the final two readings on the legislation dealing with the contract for claims run off administration and the contract with Delta Dental. She further stated there are several pieces of legislation on the agenda for our note renewals and one ordinance that allows consolidation of those notes so we can obtain a more favorable interest rate. Mrs. Fersch stated she would ask for three readings on the ordinance adopting the Pay Plan and Authorized Strength so it will be effective for the first payroll of 2007. Mrs. Fersch stated she would answer any questions anyone might have.
D. SERVICE MANAGER. Mr. Drobina stated with regard to the ordinance authorizing the contract with Jess Howard Electric for the Opticom GPS priory control system he would request two readings this evening. Mr. Drobina stated we need to enter into the contract before the end of the year in order to take advantage of the significant cost savings. Mr. Drobina stated we are doing this project with the Violet Township Fire Department, and we will purchase the equipment and have it installed, and they will then reimburse us.
E. MANAGER. Ms Gilleland stated her report had been distributed, and she would be happy to answer any questions. Ms Gilleland stated she would ask Mr. Carr to address the legislation on the Parks Master Plan and Mr. Schultz to address the legislation regarding the acceptance of the final plat for the Stonecreek Station Commercial Subdivision. Mr. Carr stated we have gone through a series of interviews with the public, and from that information we have developed seven concept plans for our parks. He stated the plan submitted to Council is the result of those efforts and he would be happy to answer any questions. Mr. Schultz stated the final plat for the Stonecreek Station Commercial Subdivision was a part of the Equity TIF project and Planning and Zoning Commission and Service Committee have recommended approval with the 12 conditions that are attached to the ordinance. Mr. Schultz stated he would be happy to answer any questions.

L.2. RESOLUTION 2006-19R, “A RESOLUTION CONFIRMING THE SAFETY COMMITTEE’S DECISION TO REDUCE THE SPEED LIMIT ON N. HILL ROAD FROM FIFTY (50) MPH TO THIRTY-FIVE (35) MPH BETWEEN JERICHO AND DILEY ROADS, PURSUANT TO PICKERINGTON CODIFIED ORDINANCES, SECTION 406.021,” Second Reading, Wisniewski. Mr. Wisniewski moved to adopt; Mr. Smith seconded the motion. Mr. Wisniewski stated this will change the speed limit north of the railroad tracks on S.R. 256 between Jericho and Diley Road down to 35 miles per hour. He stated Safety Committee felt this was appropriate for safety concerns. Roll call was taken with Mr. Smith, Mr. Fix, Mr. Wisniewski, Mrs. Hammond, Mr. Sabatino, and Mr. Hackworth voting “Yea.” Motion passed, 6-0.
9. LEGISLATIVE READINGS:
A. RESOLUTION 2006-18R, “A RESOLUTION OF ITEMS APPROPRIATED IN 2006 BUDGET AND AUTHORIZING TOTAL AMOUNT OF TRANSFERS TO NOT EXCEED AMOUNTS APPROVED, INCLUDING ANY FUTURE AMENDMENTS DURING THE 2006 BUDGET YEAR,” Third Reading, Smith. Mr. Smith moved to adopt; Mr. Fix seconded the motion. Mr. Smith stated this is Council’s affirmation that they understand that the budget approved at the first of the year will change throughout the year by various appropriations and transfers. Roll call was taken with Mr. Wisniewski, Mr. Fix, Mr. Smith, Mrs. Hammond, Mr. Hackworth, and Mr. Sabatino voting “Yea.” Motion passed, 6-0.
10. OTHER BUSINESS:
Mr. Wisniewski moved to set the Public Hearing for the proposed 2007 Budget for December 5, 2006, at 7:15 P.M.; Mr. Smith seconded the motion. Roll call was taken with Mr. Fix, Mr. Smith, Mr. Hackworth, Mrs. Hammond, Mr. Sabatino, and Mr. Wisniewski voting “Yea.” Motion passed, 6-0.
11. MOTIONS:
A. MOTION FOR EXECUTIVE SESSION UNDER SECTION 121.22(G)(3), CONFERENCE WITH LAW DIRECTOR REGARDING PENDING OR IMMINENT COURT ACTION. Mr. Smith moved for Executive Session under Section 121.22(G)(3); Mr. Wisniewski seconded the motion. Roll call was taken with Mr. Sabatino, Mrs. Hammond, Mr. Wisniewski, Mr. Smith, Mr. Hackworth, and Mr. Fix voting “Yea.” Motion passed, 6-0.
Council went into executive session at 8:40 P.M., and reconvened in open session at 9:05 P.M.
12. ADJOURNMENT. There being nothing further, Mr. Wisniewski moved to adjourn; Mr. Sabatino seconded the motion. Mr. Wisniewski, Mr. Hackworth, Mrs. Hammond, Mr. Smith, Mr. Fix, and Mr. Sabatino voted “Aye.” Motion carried, 6-0. The meeting adjourned at 9:07 P.M., November 21, 2006.
