REGULAR MEETING
6:00 P.M.
1. ROLL CALL- Mr. Wagner called the meeting to order at 6:02 p.m. with the following members present: Mrs. Dunn and Mr. Wagner. Mr. Sells was absent due to illness. Others present were: Linda Fersch, Stacey Bashore and Mark Lucas.
Mrs. Fersch reported that Mr. Sells would be resigning from the board effective immediately. She stated that several applications were on file and will be reviewed by Rules Committee.
2. APPROVAL OF MINUTES OF February 21, 2008, Regular Meeting- Mrs. Dunn moved to approve; Mr. Wagner seconded the motion. Roll call was taken with Mr. Wagner and Mrs. Dunn voting "Yea." Motion passed, 2-0.

5. PERSONNEL DIRECTOR REPORT
A. Personnel Appeals Board Regulations-Update Mrs. Fersch introduced Mark Lucas from Clemens Nelson and stated he would be reviewing the changes with the Board. Mrs. Fersch stated that she emailed a copy of the list of employees and whether they are classified or unclassified to the board. Mr. Lucas reviewed the updated changes to the rules and regulations with the Board. Mr. Wagner asked about pay ranges and Mrs. Fersch stated that we have a hiring range and the union is set on steps. Mr. Wagner asked about definitions for the hiring range and what are the rules because you can open yourself up to complaints. Mrs. Fersch stated that it is usually based on a person's experience. Mr. Wagner asked how promotions would be defined by salary or is it based on a percentage and Mrs. Fersch stated 4% has been the criteria and then the only other increases are based on what Council gives for cost of living. Mr. Wagner asked about pay ranges for demotions and how they were defined. Mrs. Dunn stated that it should be a standard percentage for demotions as well. Mrs. Fersch stated that the budget controls the salaries and the increases are then on a yearly basis. Mr. Wagner stated that from an administrative standpoint it can be very difficult to define. Mr. Wagner clarified that a lateral change could be voluntary or involuntary. Mr. Lucas stated that is was based on the State's rules and regulations as well. Mr. Wagner asked about what defined a break in service and Mrs. Fersch stated it was defined in the employee manual. Mrs. Dunn asked about what happens to a classified employee who was convicted of a felony and Mr. Lucas stated there is a statement filed with the Personnel Appeals Board. Mr. Wagner asked about disqualifications of applicants who were discharged with cause and Mr. Lucas stated it was a State standard. Mr. Lucas stated that the charter certification was for employees who worked for the City when it was a village. Mrs. Dunn stated that the language would have to remain until there are no longer any employees affected by it. Mr. Wagner asked why the 30 day overlap of a temporary employee was struck because it was a great tool to help the transition go smoother. Mr. Lucas stated that it could be left in if the personnel policies provide for that. Mr. Wagner asked about bona fide occupational qualifications and stated they are difficult to prove legal. Mr. Lucas stated that it could be set up for a jail or police work. Mr. Wagner requested that the word be struck if there was no need for it. Mr. Wagner asked about felony convictions and Mr. Lucas stated that a classified employee loses their classified status if they are convicted of a felony. Mrs. Fersch asked a question about performance evaluations being provided to the Board at their request and she didn't remember it ever being done. Mr. Wagner stated it would only be if the Board requested one if they are investigating someone. Mrs. Fersch stated that the revised rules will need to be voted on as a clean copy and Mr. Lucas stated he will review it again and the employee policy manual will need to be revised first to match the changes made in the PAB rules. Mrs. Fersch stated the employee manual could be effective in July and the rules could be passed by the Board after that. Mr. Lucas stated he would try to have it completed for the April meeting.
6. PERSONNEL ACTION- Mrs. Fersch reported that one of the police officers has resigned to go to the Newark Police Department and the Police Department has been interviewing the top six certified candidates. Mrs. Fersch stated that we realized that when the top six were approved they all had their OPOTA certification so it wasn't issue, but the test that was given had only 90 questions instead of 100. She stated that when the letters were sent saying they had passed the test it was based on 75% of the 90 so she added the remaining names to the updated list and requested that the updated list be certified. Mr. Wagner clarified that the results were not changed by the additions. Mrs. Fersch stated that the list would be good for two years unless it was exhausted before then. She stated it would need to be certified under the Eligibility List section of the agenda. Mrs. Fersch reported that one of the police dispatchers has been enlisted into the National Guard and will be on duty once a month and will be in basic training for 19 weeks. She stated that we would need to hire a temporary employee to cover in between. Mrs. Fersch stated that she had the authorized strength and classifications for the swimming pool employees. She stated that we are adding two manager positions and those would fall under the seasonal recreational assistant 2 and increased the hiring pay range for those positions. She stated that the lifeguards and concession stand employees would fall under an assistant 1 position. Mrs. Fersch stated that these will be passed at the next Council meeting.
7. ELIGIBILITY LISTS- Mr.
Wagner stated that based on the information reported by Mrs. Fersch he would like to approve the revised Police
eligibility list. Mr. Wagner moved to approve the revised Police eligibility list; Mrs.
Dunn seconded the motion. Roll call
was taken with Mr. Wagner and Mrs. Dunn voting "Yea". Motion
passed, 2-0.
8. OTHER BUSINESS-
There was none.
9. ADJOURNMENT: There being nothing further, Mr. Wagner
moved to adjourn; Mrs. Dunn seconded the motion. Mr. Wagner and Mrs. Dunn voted
"Aye." Motion carried
2-0. The Personnel Appeals Board adjourned
at 6:45 p.m. on March 20, 2008.
