BOARD OF ZONING APPEALS

PUBLIC HEARING

7:00 P.M.

 

1.         Mr. Wells called the public hearing to order at 7:08 P.M., with the following members present:  Mr. Wright, Mr. Wells, and Mr. Boruszewski.  Mr. Linek and Mr.Cline were absent.  Others present were:  Lance Schultz, Lynda Yartin, Joe Henderson, Chris Carter, Jeanette Boruszewski, and others.

 

2.         APPROVAL OF MINUTES OF June 26, 2008, Regular Meeting.  Mr. Boruszewski moved to approve; Mr. Wright seconded the motion.  Roll call was taken with Mr. Wells, Mr. Boruszewski, and Mr. Wright voting “Yea.”  Motion passed, 3-0. 

 

3.         SCHEDULED MATTERS: 

 

A.        Review and request for a motion to approve a rear yard building setback variance for a deck at 680 Manchester Drive (Manchester Subdivision).  Mr. Henderson stated the property owners were proposing to construct a deck approximately 16x16 feet (260 square feet), with stairs on the north side of the deck that would protrude seven feet into the rear yard setback.  He stated the property is zoned in an R-4 Residential zoning and should have a 35 foot rear yard setback, so it would be 28 feet from the rear of the deck to the property line so this would be a 20 percent variance.  Mr. Henderson stated staff supports the rear yard building setback variance request with the condition that the rear yard setback for the deck shall be reduced from 35 to 28 feet. 

 

            Mr. Chris Carter stated he is the applicant and he would be happy to answer any questions the Board may have. 

 

            Mr. Wells ascertained there were no questions from the Board members. 

 

            Mr. Boruszewski moved to approve the request that the rear yard building setback variance for the deck shall be reduced from 35 to 28 feet; Mr. Wright seconded the motion.  Roll call was taken with Mr. Wright, Mr. Boruszewski, and Mr. Wells voting “Yea.”  Motion passed, 3-0. 

 

4.         OTHER BUSINESS.  Mr. Schulz stated the next two regularly scheduled meetings would fall on Thanksgiving Day and Christmas Day.  He stated staff would recommend if meetings would be required for those two months that they be scheduled for the third Thursday of the month.  Mr. Wells moved to schedule the November 2008, Board of Zoning Appeals, if required, for Thursday, November 20, 2008, and to schedule the December 2008, Board of Zoning Appeals, if required, for Thursday, December 18, 2008; Mr. Boruszewski seconded the motion.  Roll call was taken with Mr. Boruszewski, Mr. Wright, and Mr. Wells voting “Yea.”  Motion passed, 3-0. 

 

5.         ADJOURNMENT.  There being nothing further Mr. Boruszewski moved to adjourn, Mr. Wright seconded the motion.  Mr. Wells, Mr. Boruszewski, and Mr. Wright voted “Aye.”  Motion carried, 3-0.  The Board of Zoning Appeals adjourned at 7:18 P.M., October 23, 2008.
