BOARD OF ZONING APPEALS

PUBLIC HEARING

7:00 P.M.

 

1.         Mr. Linek called the public hearing to order at 7:00 P.M., with the following members present:  Mr. Linek, Mr. Wright, Mr. Boruszewski, and Mr. Wells.  Mr.Cline was absent.  Others present were:  Lance Schultz, Lynda Yartin, Joe Henderson, Vincent Vacheresse, and Robin Vacheresse. 

 

2.         APPROVAL OF MINUTES OF October 23, 2008, Regular Meeting.  Mr. Wells moved to approve; Mr. Boruszewski seconded the motion.  Roll call was taken with Mr. Wells, Mr. Boruszewski, Mr. Wright, and Mr. Linek voting “Yea.”  Motion passed, 4-0. 

 

3.         SCHEDULED MATTERS: 

 

A.        Review and request for a motion to approve a height variance, a maximum square footage variance, and a length to width variance for a detached garage at 8240 Long Road.  Mr. Henderson stated the applicant proposed to build a detached garage on the rear of the property that would encompass 1,152 square feet (24-ft x 48-ft).  He stated the purpose of the detached garage would be for general garage use and would be a pole barn building with metal sides on three sides and roof.  He further stated they were proposing either a vinyl or cedar lapboard on the elevation that is perpendicular to Long Road.   

 

                        Mr. Henderson stated the applicant is requesting three variances for the proposed detached garage.  One for building height, one for maximum square footage, and one for a length to width ratio.  Mr. Henderson stated the maximum square footage for a detached garage is 960 square feet in an R-1 zoned district and this would be 192 square feet, which is 20 percent larger than allowed.  He further stated the building height is one foot taller than the 15 foot maximum, and the length to width would be a two to one ratio.  Mr. Henderson continued that the garage would be located approximately 850-feet from the road and is on a nontraditional lot of approximately 4.67 acres.  He stated the lot is rural in character, is not located in a subdivision, and is surrounded by other large residential and agricultural zoned parcels.  Mr. Henderson stated staff supports the height variance, a maximum square footage variance, and a length to width variance for the detached garage with the following conditions:

 

                        1.         That the maximum size on the detached garage shall not exceed 1,152 square feet.

 

                        2.         That the height of the detached garage shall not exceed 16-feet.

 

                        3.         That the dimensions of the detached garage shall be 24-ft x 48-ft; a 2:1 length to width ratio. 

 

            Mr. Vacheresse was sworn and stated he was present to answer any questions the Board may have.  Mr. Vacheresse stated he felt the only issue is the color as the owner wants a traditional barn and in her opinion that is red.  Mr. Schultz stated the Planning and Zoning Commission approved the structure with the condition that it must match the house.  He stated since the house is coming later we will need to ensure that the barn is compatible with the house.  He stated when the plans are submitted he will ensure it is compatible. 

 

            Mr. Boruszewski moved to approve the request for a height variance, a maximum square footage variance, and a length to width variance for a detached garage at 8240 Long Road with staff’s conditions that the square footage shall not exceed 1,152 square feet, the height shall not exceed 16-feet, and that the dimensions of the detached garage shall be 24-ft x 48-ft, a 2:1 length to width ratio; Mr. Wells seconded the motion.  Roll call was taken with Mr. Wright, Mr. Linek, Mr. Boruszewski, and Mr. Wells voting “Yea.”  Motion passed, 4-0. 

 

4.         OTHER BUSINESS.  No other business was brought forward. 

 

5.         ADJOURNMENT.  There being nothing further Mr. Wells moved to adjourn, Mr. Boruszewski seconded the motion.  Mr. Boruszewski, Mr. Wright, Mr. Linek, and Mr. Wells voted “Aye.”  Motion carried, 4-0.  The Board of Zoning Appeals adjourned at 7:10 P.M., December 18, 2008.
