BOARD OF ZONING APPEALS

PUBLIC HEARING

7:00 P.M.

 

1.         Mr. Linek called the public hearing to order at 7:00 P.M., with the following members present:  Mr. Linek, Mr. Boruszewski, Mr. Wells, and Mr. Cline.  Mr. Wright was not present as he was out of town.  Others present were:  Joe Henderson, Lynda Yartin, Mark Nicholas, and Joe Kussmaul. 

 

2.         APPROVAL OF MINUTES OF December 18, 2008, Regular Meeting.  Mr. Wells moved to approve; Mr. Boruszewski seconded the motion.  Roll call was taken with Mr. Wells, Mr. Boruszewski, Mr. Linek, and Mr. Cline voting “Yea.”  Motion passed, 4-0. 

 

3.         SCHEDULED MATTERS: 

 

A.        Review and request for a motion to approve a front yard building setback variance for a fence at 618 Brighton Court (Preston Trails subdivision).   Mr. Henderson stated the owner is proposing to build a five-foot high wood fence that would encompass the backyard.  He stated the home is located on a corner lot, which by Code requires two front yards.  Mr. Henderson stated the applicant is requesting a variance to reduce the front yard setback from 30-feet to approximately 20-feet along Brighton Street.  Mr. Henderson reviewed the report submitted to the Board and stated staff supports the front yard setback variance request for the fence with one condition:  That the front yard setback for the fence shall be reduced from 30-feet to 20-feet along Brighton Street per the submitted plan. 

 

            Mr. Boruszewski moved to approve the front yard building setback variance for a fence at 618 Brighton Court with the condition that the front yard setback be reduced from 30-ftt to 20-feet along Brighton Street per the submitted plan; Mr. Wells seconded the motion.  Roll call was taken with Mr. Cline, Mr. Linek, Mr. Boruszewski, and Mr. Wells voting “Yea.”  Motion passed 4-0. 

 

B.         Review and request for a motion to approve side yard building and parking setback variances for a carport for Violet Limousine Services, Inc., located at 103 East Columbus Street.  Mr. Henderson stated the applicant is proposing a 540 square foot addition to the existing automotive garage building to create a carport for one of the limousines that he currently stores on the site in the parking lot.  Mr. Henderson reviewed the report submitted to the Board.  Mr. Henderson stated staff supports the side yard building and parking setback variances with one condition:  That the side yard building and parking setbacks shall be reduced from 15-feet and 9-feet respectively to 1-foot. 

 

Mr. Kussmaul, the applicant, after being duly sworn, stated he has been in contact with Norfolk Railroad since his property is close to their property, and they have no issues with this.  He stated he would be happy to answer any questions. 

 

            Mr. Cline moved to approve the side yard building and parking setback variances for a carport for Violet Limousine Services, Inc., located at 103 East Columbus Street, with the condition that the side yard building and parking setbacks shall be reduced from 15-feet and 9-feet respectively to 1-foot; Mr. Linek seconded the motion.  Roll call was taken with Mr. Boruszewski, Mr. Linek, Mr. Cline, and Mr. Wells voting “Yea.”  Motion passed, 4-0.   

 

4.         OTHER BUSINESS.  No other business was brought forward. 

 

5.         ADJOURNMENT.  There being nothing further Mr. Cline moved to adjourn, Mr. Wells seconded the motion.  Mr. Boruszewski, Mr. Cline, Mr. Linek, and Mr. Wells voted “Aye.”  Motion carried, 4-0.  The Board of Zoning Appeals adjourned at 7:13 P.M., April 23, 2009.
