BOARD OF ZONING APPEALS

PUBLIC HEARING

7:00 P.M.

 

1.         Mr. Cline called the public hearing to order at 7:00 P.M., with the following members present:  Mr. Boruszewski, Mr. Cline, and Mr. Wright.  Mr. Linek and Mr. Wells were absent.  Others present were:  Joe Henderson, Lynda Yartin, and Kenneth Parr. 

 

2.         APPROVAL OF MINUTES OF June 25, 2009, Regular Meeting.  Mr. Boruszewski moved to approve; Mr. Wright seconded the motion.  Roll call was taken with Mr. Boruszewski, Mr. Wright, and Mr. Cline voting “Yea.”  Motion passed, 3-0. 

 

3.         SCHEDULED MATTERS: 

 

A.        Review and request for a motion to approve a rear yard setback variance for a deck at 49 Knights Bridge Drive (Sheffield Subdivision).  Mr. Henderson reviewed staff’s report provided to the Board members and stated the owner is proposing to construct a deck that is approximately 14 feet by 18 feet with stairs on the north side of the deck.  He stated the deck would protrude 15 feet into the rear yard setback.  Mr. Henderson stated this Board has approved several similar requests where decks/porches protruded less than 50 percent into the rear yard setback.  He further stated there are a lot of shallow lots in the City and it only makes practical sense to allow homeowners to utilize their rear yards when the requests are not extreme.  Mr. Henderson stated staff supports the rear yard building setback variance request for the deck with minimum zoning requirements and the following condition: 

 

            1.         That the rear yard setback for the deck shall be reduced from 35 feet to 20 feet. 

 

Mr. Kenneth Parr, after being duly sworn, stated he is the homeowner and the applicant.  Mr. Parr stated basically without the deck he cannot use his back yard because the yard slopes down to a drainage pond.  He stated with the deck he is trying to claim some of the yard so he can use it. 

 

Mr. Wright clarified other homes along the drainage pond do not have decks, however, some in the middle of the subdivision do have decks.  Mr. Henderson stated in the past variances have been approved for decks in this area. 

 

Mr. Wright moved to approve a rear yard building setback variance for a deck at 49 Knights Bridge Drive with minimum zoning requirements and the condition that the rear yard setback for the deck shall be reduced from 35 feet to 20 feet; Mr. Boruszewski seconded the motion.  Roll call was taken with Mr. Wright, Mr. Cline, and Mr. Boruszewski voting “Yea.”  Motion passed, 3-0. 

 

 4.        OTHER BUSINESS.  Mr. Cline clarified that the next Board of Zoning Appeals hearing will be on August 27, 2009, and it appears there will be one item for the agenda at this time. 

 

5.         ADJOURNMENT.  There being nothing further Mr. Cline moved to adjourn, Mr. Boruszewski seconded the motion.  Mr. Boruszewski, Mr. Wright, and Mr. Cline voted “Aye.”  Motion carried, 3-0.  The Board of Zoning Appeals adjourned at 7:08 P.M., July 30, 2009.
