BOARD OF ZONING APPEALS

PUBLIC HEARING

7:00 P.M.

 

1.         Mr. Linek called the public hearing to order at 7:00 P.M., with the following members present:  Mr. Linek, Mr. Boruszewski, and Mr. Cline.  Mr. Wright and Mr. Wells were absent.  Others present were:  Joe Henderson, Lynda Yartin, John Zornes, Marsha Zornes, and William Whalen. 

 

2.         APPROVAL OF MINUTES OF July 30, 2009, Regular Meeting.  Mr. Cline moved to approve; Mr. Boruszewski seconded the motion.  Roll call was taken with Mr. Boruszewski, Mr. Linek, and Mr. Cline voting “Yea.”  Motion passed, 3-0. 

 

3.         SCHEDULED MATTERS: 

 

A.        Review and request for a motion to approve a rear yard building setback variance for a deck at 113 Blaine Court (Windmiller Ponds Subdivision)  Mr. Henderson reviewed the report presented to the Board members and stated the applicant was proposing to construct a deck that would protrude 11-feet into the rear yard setback.  Mr. Henderson stated staff supported the rear yard building setback variance request for the deck with minimum zoning requirements and the following condition:

 

            1.         That the rear yard setback for the deck shall be reduced from 35 feet to 24 feet. 

 

Mr. Whalen, after being duly sworn, stated he would answer any questions the Board may have. 

 

Mr. Boruszewski moved to approve the request that the rear yard setback for the deck shall be reduced from 35-feet to 24-feet; Mr. Cline seconded the motion.  Roll call was taken with Mr. Boruszewski, Mr. Cline, and Mr. Linek voting “Yea.”  Motion passed, 3-0. 

 

B.         Review and request for a motion to approve a front yard building setback variance for a fence at 320 Evening Way (Pickerington Meadows Subdivision).  Mr. Henderson reviewed the report provided to the Board members and stated the subject house is located on a corner lot which, by Code, requires two front yards.  He stated the owner is proposing to build a four-foot high black coated chain link fence that would encompass the backyard.  Mr. Henderson stated the applicant is requesting a variance to reduce the front yard setback from 25-feet to approximately 16-feet along Evening Way.  Mr. Henderson stated staff supports the front yard setback variance request with the following condition:

 

            1.         That the front yard setback for the fence shall be reduced from 25-feet to 16-feet along Evening Way per the submitted plan. 

 

Mr. Zornes, after being duly sworn, stated they wanted to put in a fence before they purchase a dog, and he would answer any questions anyone might have. 

 

Mr. Cline moved to approve the front yard setback for a fence  shall be reduced from 25-feet to 16-fet along  320 Evening Way per the submitted plan; Mr. Boruszewski seconded the motion.  Roll call was taken with Mr. Cline, Mr. Linek, and Mr. Boruszewski voting “Yea.”  Motion passed, 3-0. 

 

 4.        OTHER BUSINESS.  Mr. Linek clarified that the next Board of Zoning Appeals hearing, if needed, will be on October 22, 2009. 

 

5.         ADJOURNMENT.  There being nothing further Mr. Boruszewski moved to adjourn, Mr. Cline seconded the motion.  Mr. Boruszewski, Mr. Linek, and Mr. Cline voted “Aye.”  Motion carried, 3-0.  The Board of Zoning Appeals adjourned at 7:10 P.M., September 24, 2009.
