PUBLIC HEARING

OPEN DISCUSSION REGARDING REZONING OF 101 HILL ROAD NORTH

 

 

 

1.         Call to Order.  Mayor O’Brien opened Public Hearing at 7:15 P.M.

 

2.         Roll Call:  Roll call was taken with Mrs. Sanders, Mr. Fix, Mr. Smith, Mr. Sauer, Mrs. Hammond, Mr. Sabatino, Mr. Wisniewski, and Mayor O’Brien present.  No memers were absent.  Others present were:  Tim Hansley, Lynda Yartin, Greg Bachman, Lance Schultz, Chief Mike Taylor, Phil Hartmann, Ed Drobina, Nate Ellis, Carol Carter, Anita Meade, Amy Hackman, Larry Folk, Eva Langston, Tracy Langston, Gavin Blair, Gary Weltlich, Rachel Schofeld, and others. 

 

3.                   Purpose of the Public Hearing:  To allow citizens a chance to voice any concerns and/or questions about the proposed rezoning and Final Development Plan of 101 Hill Road North from R-4 (Residential) to PO (Planned Suburban Office). 

 

4.         Presentation to Council: 

 

            A.        Mr. Schultz stated Planning and Zoning Commission and Service Committee both approved the proposed rezoning and Final Development Plan in August of this year with ten conditions.  Mr. Schultz stated the property is currently a house, however, the owner intends to convert it into a beauty salon with a 14 space parking lot in the rear. 

 

5.         Council Questions/Comments:  Mr. Wisniewski clarified when the property owner purchased the property they were under the impression, according to our books, that this was already zoned commercial.  Mr. Schultz stated that was correct.  Mr. Schultz stated when this went before Planning and Zoning and the Board of Zoning Appeals one of the neighbors questioned the zoning of her property and this property.  He stated he had done research and discovered that these parcels were never zoned commercial, but were always zoned residential.  Mr. Schultz stated between 1996 and 2000 our zoning map was revised a few times and the zoning category designation of these parcels were incorrectly shown as being zoned commercial.   .

 

6.         Public Comments/Questions: 

 

            A.        Patsy Woodruff stated she lives to the north of this property and it is not the idea of a beauty shop or a business going in there that concerns her, it is the idea that there could be a large amount of customers going in and out when there is only one way in and one way out.  She stated on that street, all the other businesses have an alley to the back or an exit out and this one does not.  Ms Woodruff stated her concern is the access because this is a heavily trafficked area. 

 

            B.         Eva Langston.  Ms Langston stated she is the owner of the property and clarified that currently she will be the only employee at the salon.  She stated she would eventually like to have other operators rent spaces, but they would be working part time so there would not be a lot of traffic going in and out all the time.  Ms Langston stated she had checked with the zoning department several times when she was purchasing this property and she was under the impression this was a commercial property.  Ms Langston further stated she does not take walk-in clients, but is by appointment only. 

 

            C.        Anita Meade.  Ms Meade stated she lives at 103 Hill Road North and she has the same concern about safety with the traffic as well as pedestrian traffic.  Ms Meade stated she has lived there for 45 years, and when she moved in she wanted to live in a residential community not surrounded by businesses.  Ms Meade stated now she is at a point where she is getting surrounded. 

 

            D.        Larry Folk.  Mr. Folk stated he is the architect for the applicant and he would like to point out that the addition to the house has been shifted enough to get a definite entryway and exit.  He stated further they will meet all of the conditions required by Planning and Zoning.  Mr. Folk stated he would answer any questions anyone might have. 

 

Mr. Fix inquired if the City had exposure based on the fact that our zoning maps were not correct, and Mr. Hartmann stated the City would not, they would have immunity from that.  Mr. Hartmann stated it is not uncommon for maps to have mistakes and they are not usually used as the final zoning document. 

 

7.         Adjournment.  There being nothing further, Mayor O’Brien closed the public hearing at 7:25 P.M., October 6, 2009.
