BOARD OF ZONING APPEALS

PUBLIC HEARING

7:00 p.m.

 

 

1.         Mr. Well called the public hearing to order at 7:00 P.M. with the following members

present: Mr. Boruszewski, Mr. Wells and Mr. Cline.  Mr. Linek and Mr. Wright were absent.  Others present were Joe Henderson, Karen Risher, Cynthia Whitman, Richard Jones, Allen Jones, Jennifer Jones and James Sawyers.

 

2.         APPROVAL OF MINTUES OF May 27, 2010, Regular Meeting. Mr. Boruszewski moved to approve; Mr. Cline seconded the motion. Roll call was taken with Mr. Wells, Mr. Boruszewski and Mr. Cline voting “Yea”.  Motion passed, 3-0.

 

3.         SCHEDULED MATTERS:

 

            A.        Review and request for a motion to approve a front yard building setback variance for a fence at 698 Isabel Court (Manchester Subdivision). 

 

Mr. Henderson reviewed the report provided to the Board members and stated the applicant’s house is on a corner lot and by code has two front yards.  The owner is proposing a four feet high cedar picket fence that would encompass the back yard.  A portion of the fence encroaches into the 35 feet front yard setback along Manchester Drive.  The applicant is requesting a variance to reduce the front yard setback from 35 feet to approximately 20 feet along Manchester Drive.  Staff supports the front yard setback variance request for a fence that complies with the minimum zoning code requirements and with the following condition:

 

            1.  That the front yard setback for the fence shall be reduced from 35 feet to 20 feet along Manchester Drive.  

 

Mr. Richard Jones, after being duly sworn, stated that the owner has grandchildren and the fence is being built for their safety.  There were no further comments or questions.

 

Mr. Boruszewski moved to approve the request that the front yard setback for the fence shall be reduced from 35 feet to 20 feet along Manchester Drive.  Mr. Cline seconded the motion.  Roll call was taken with Mr. Cline, Mr. Boruszewski and Mr. Wells voting “Yea”.  Motion passed, 3-0.

 

           

 

 

 

B.         Review and request for a motion to approve a front yard building setback variance for a fence at 599 Cranborn Court (Manchester Subdivision).  

 

Mr. Henderson reviewed the report provided to the Board members and stated the applicant’s house is on a corner lot and by code has two front yards.  The owner is proposing a four foot high wood fence that encompasses the backyard.  A portion of the fence encroaches into the 35 feet front yard setback along the northern side of the property along Manchester.  The applicant is requesting a variance to reduce the front yard setback from 35 feet to approximately 20 feet along Manchester Drive. Staff supports the front yard setback variance request for a fence that complies with the minimum zoning code requirements and with the following condition:

 

            1.  That the front yard setback for the fence shall be reduced from 35 feet to 20 feet along Manchester Drive.

 

Mr. Allen Jones, after being duly sworn, stated he wants the depth of his fence to be consistent with his neighbor’s fence.  There were no further comments or questions.

 

Mr. Wells moved to approve the request that the front yard setback for the fence shall be reduced from 35 feet to 20 feet along Manchester Drive.  Mr. Cline seconded the motion.  Roll call was taken with Mr. Boruszewski, Mr. Cline and Mr. Wells voting “Yea”.  Motion passed, 3-0.

 

            C.        Review and request for a motion to approve a rear yard building setback variance for a deck at 82 Knights Bridge Drive (Sheffield Subdivision).

 

Mr. Henderson reviewed the report provided to the Board members and stated the owner is proposing a 12 feet by 14 feet deck.  The deck would protrude three feet into the rear yard setback. Staff supports the rear yard building setback variance request for the deck with minimum zoning requirements with the following condition:

 

            1.  That the rear setback for the deck shall be reduced from 35 feet to 32 feet.

 

Mr. James Sawyers, after being duly sworn, stated that he is requesting this so that there will be enough room for deck furniture. There were no further comments or questions.

 

Mr. Cline moved to approve the rear setback for the deck shall be reduced from 35 feet to 32 feet; Mr. Wells seconded the motion.  Roll call was taken with Mr. Boruszewski, Mr. Cline and Mr. Wells voting “Yea.  Motion passed, 3-0

 

4.         OTHER BUSINESS:  None.

 

 

 

 

 

5.         ADJOURNMENT:  Mr. Well moved to adjourn; Mr. Boruszewski seconded the motion.  Mr. Wells, Mr. Cline and Mr. Boruszewski voted “AYE”.  Motion carried, 3-0.  The Board of Zoning Appeals adjourned at 7:10 P.M., June 24, 2010.
