PUBLIC HEARING

 

OPEN DISCUSSION REGARDING PROPOSED

AMENDMENTS TO CHAPTER 1276.10, ACCESSORY AND CONDITIONAL USES, CHAPTER 1286.15, DAY CARE REGULATIONS, AND APPENDIX I, TABLE 1 PERMITTED USES (P); ACCESSORY USES (A), AND CONDITIONAL USES (C) REGULATIONS

 

 

 

1.         Call to Order.  Mayor O’Brien opened the Public Hearing at 7:10 P.M.

 

2.         Roll Call:  Roll call was taken with Mrs. Sanders, Mr. Blair, Mr. Sauer, Mrs. Hammond, Mr. Barletta, and Mayor O’Brien present.  Mr. Fix and Mr. Wisniewski were absent.  Others present were:  Bill Vance, Lynda Yartin, Chief Mike Taylor, Lance Schultz, Greg Bachman, Phil Hartmann, Ed Drobina, Chris Schornack, Susan Crotty, Chet Hopper, Tory Kramer, Ted Hackworth, Nate Ellis, Carol Carter, Alexa Liebert, and others. 

 

3.                   Purpose of the Public Hearing:  To allow citizens a chance to voice any concerns and/or questions regarding the proposed amendments to Chapter 1276.10, Accessory and Conditional Uses, Chapter 1286.15, Day Care Regulations, and Appendix I; Table 1 Permitted Uses (P); Accessory Uses (A), and Conditional Uses (C) Regulations

 

4.         Presentation to Council: 

 

            A.        Mr. Schultz stated Planning and Zoning Commission and Service Committee approved this item at their meeting in June 2010.  He stated this revision to the Code allows day cares as a conditional use in the R-6 District.  Mr. Schultz stated R-6 District is the only residential district in the city that does not allow day cares as a conditional use and staff and the city attorney believe this was an oversight when the Code was written.  He stated a church located on Church Street would like to have a day care use and they are zoned R-6.  Mr. Schultz stated the options were to have the Church do a rezoning or have the City revise the Code and it was determined we would revise the Code.  Mr. Schultz stated the residents in the neighborhood were notified of this hearing and he has talked with two individuals and explained this issue.  He stated they voiced no objections. 

 

5.         Resident Comments/Questions:  There were no resident comments or questions. 

 

6.         Council Questions/Comments:  Mayor O’Brien determined there were no questions by Council. 

           

7.         Adjournment.  There being nothing further, Mayor O’Brien closed the public hearing at 7:13 P.M., July 20, 2010.
