BOARD OF ZONING APPEALS

PUBLIC HEARING
7:00 P.M.
1. Mr. Linek called the public hearing to order at 7:00 P.M. with the following members present: Mr. Linek, Mr. Allen, Mr. Wells, and Mr. Cline. Mr. Wright was absent as he was out of town. Others present were Joe Henderson, Karen Risher and Alison Lies.
2. APPROVAL OF MINUTES
OF October 28, 2010, Regular Meeting. Mr. Cline moved to approve; Mr. Linek seconded the motion. Roll call was taken with Mr.
Cline, Mr. Wells, Mr. Allen and Mr. Linek voting
“Yea”. Motion passed, 4-0.
3. SCHEDULED MATTERS:
A. Review and request for a motion to
approve a front yard parking setback variance for The Offices at Stonecreek along
Mr. Henderson reviewed the report provided to the Board members and stated the applicant is proposing to amend a parking setback variance along the northern property line west of the first access drive on Stonecreek Drive South coming westbound from Hill Road North. They are requesting a variance to amend the parking setback from 18 feet to 10 feet. This would allow for a second row of parking along the north side of the office building.
Staff supports the front yard parking setback variance request that complies with the minimum zoning code requirements and the following conditions:
1. That the parking setback west of the first access drive on Stonecreek Drive South shall be reduced from 18 feet to 10 feet.
2. That increased landscaping along
Mr. Linek clarified there will still be enough area behind the sidewalk for the mounding and landscaping. Mr. Henderson stated the applicant will be at the next Planning and Zoning meeting for Site Plan and Architecture approval and a few months later for approval on the landscaping.
Alison Lies, after being duly sworn, stated she is here to represent the applicant and would answer any questions. She stated the applicant is not opposed to the condition for additional landscaping for screening of the parking area.
Mr. Wells moved to approve that the front yard setback variance for parking shall be reduced from 18 feet to 10 feet along Stonecreek Drive South and that increased landscaping along Stonecreek Drive South, west of the first access drive, shall be installed once the northern building is constructed; Mr. Allen seconded the motion. Roll call was taken with Mr. Cline, Mr. Linek, Mr. Allen and Mr. Wells voting “Yea”. Motion passed, 4-0.
4. OTHER BUSINESS: Mr.
Henderson apologized for getting the packets out late. Planning and Zoning Commission was this week
as well and the department is down to one City Planner as the Director of
Planning and Zoning will not be returning.
Mr. Henderson stated that if there is a Board of Zoning Appeals meeting
in January it may be moved up to 6:30 P.M.. The City Manager has requested a
meeting on Heritage
5. ADJOURNMENT: There being nothing further Mr. Wells moved to adjourn, Mr. Cline seconded the motion. The Board of Zoning Appeals adjourned at 7:08 P.M., December 16, 2010.
