DEVELOPMENTS, IDENTIFYING SETBACK REQUIREMENTS IN MULTI-FAMILY DEVELOPMENTS AND OTHER
PERTINENT REVISIONS
Mr. England
opened the public hearing at 7:20 P.M., with the following members of the Planning
and Zoning Commission present: Mayor
Postage, Mr. Smith, Mr. Sabatino, Mr. Nicholas, Mr.
England, Mr. Bosch, and Mr. Maxey.
Others present were: Lance Schultz, Lynda Yartin,
Mike Pirwitz, and others.
Mr. England asked if there was any discussion for or against these revisions.
Mr. Maxey stated he would like to comment that right now, for all intents and purposes, this is a moot point given that we cannot approve any multi-family developments due to the last election results, however, although it may not be used right now, these revisions will clean up the Code. He further stated his comments were not meant for or against these revisions, just to point out that the initiative that passed in the November election precludes the City from developing in a multi-family fashion. Mr. England stated he felt the revisions should be in the Code in the event that either through the courts or some other government action, our Code will be updated.
Mr. Schultz stated that Mr. Maxey was correct in that the majority of the revisions relate to multi-family developments. Mr. Schultz further stated the revisions also include allowing the engineer to determine in commercial or industrial developments if roadways should be private or public, and if there should be 18 inch curbs or extruded curbs.
Mr. Sabatino also stated these revisions included the ability for staff and the Planning and Zoning Commission to require sidewalks in multi-family developments.
Mr. England ascertained there were no further comments and declared the public hearing closed at 7:28 P.M., January 14, 2003.

1. ROLL CALL. Mr. England called the meeting to order at 7:30 P.M., with roll call as follows: Mayor Postage, Mr. Smith, Mr. Sabatino, Mr. Nicholas, Mr. England, Mr. Bosch, and Mr. Maxey were present. No members were absent. Others present were: Lance Schultz, Lynda Yartin, Bob Mapes, Mike Pirwitz, and others.
2. APPROVAL OF MINUTES OF December 10, 2002, Regular Meeting. Mr. Sabatino moved to approve; Mr. Bosch seconded the motion. Mr. England, Mr. Sabatino, Mr. Nicholas, Mr. Smith, Mr. Bosch, Mr. Maxey, and Mayor Postage voted “Aye.” Motion carried, 7-0.
3. SCHEDULED MATTERS:
A. Review and request for motion to approve the rezoning of 28.548+/- acres from AG (Rural District) to R-4 (Residential District) for a single-family development located north of Long Road and south of the railroad tracks and just west of the proposed Long Estates Subdivision for Rockford Homes (Woodward property). (TABLED, 11-12-02)
B. Review and request for motion to approve Olde Pickerington Design Guidelines Certificate of Appropriateness for signage for Pickerington Heating and Cooling at 22 North Center Street. (TABLED, 11-12-02)
C. Review and request for motion to approve a final development plan for Long Estates Phase II a single-family development on approximately 79.89 acres for William Lane located north of Long Road and south of the railroad tracks (Lane property). (TABLED, 11-12-02)
D. Review and request for motion to approve Olde Pickerington Design Guidelines Certificate of Appropriateness for signage for Xterior Experts of Ohio, at 8 Lockville Road. Mr. Schultz stated the owner proposes to replace the current sign with a new wall sign. He stated the sign would be rectangular in shape and would be the same size (twelve square feet) and in the same location as the existing sign. Mr. Schultz stated the sign would be comprised of wood with green, red, blue, and black lettering on a white background. Mr. Schultz further stated the zoning code restricts signs to three colors or less and this sign has, including white, five colors. Mr. Schultz stated staff supported approval of the certificate of appropriateness on the condition that the number of colors on the sign be reduced to three. Mr. Schultz stated white is considered to be a color. Mr. England ascertained Mr. Pirwitz was present representing the applicant. Mr. England further ascertained these were two divisions of the same company; one division does exterior work such as decks and fences, and the other does things such as basements, bathrooms, and kitchens. Mr. England inquired if it would be a problem if both division names were in the same color and Mr. Pirwitz stated it would not. Mr. Maxey ascertained it was not necessary to have the telephone number twice on the sign. Mr. Bosch stated he had no objections to the sign if they could get it down to three colors. Mr. Sabatino moved to approve the sign with the limit of three colors; Mr. Maxey seconded the motion. Mr. Schultz informed Mr. Pirwitz that he would need a sign permit showing the revised color scheme. Roll call was taken with Mr. England, Mr. Nicholas, Mr. Sabatino, Mayor Postage, Mr. Bosch, Mr. Smith, and Mr. Maxey voting “Yea.” Motion passed, 7-0.
E. Review and request for motion to approve a Conditional Use Permit for Cottman Transmission at 860 Refugee Road. Mr. Schultz stated the proposed use would be just east of the Below Clearance/Auto Zone site and the applicant is proposing a new building. Mr. Schultz stated the building would be a one story, 3,600 square foot building for automotive services. He further stated two curb cuts would access the site from Refugee Road and parking would be shared with the Below Clearance/Auto Zone facility, and the stormwater would likely be contained in the parking lot. Mr. Schultz stated the proposed use and three other uses in the area would share two curb cuts. Mr. Schultz stated typically a 25 foot setback is required for landscaping, however, since this is a renovated use with the dedication of right-of-way only 12 feet is required. He further stated the other uses in the area do not have 25 feet, therefore, he felt this met the intent of the zoning code. Mr. Schultz stated a certificate of appropriateness for lighting will ensure that all lighting requirements are met. He further stated this use is compatible with the other existing automotive uses in the area. Mr. Schultz stated staff supported the request with the conditions that the proposed building meet all zoning requirements and the proposed building meet the commercial design guidelines. Mr. Schultz stated the applicant was anxious to begin and he was surprised they were not here this evening. Mr. Sabatino clarified this request was to allow the use of this site and the next agenda item dealt with the design of the building and the site plan. Mr. Sabatino also clarified the two curb cuts are the existing curb cuts, no new ones would be required. Mr. Nicholas moved to approve the conditional use permit with the conditions stated by staff; Mr. Sabatino seconded the motion. Roll call was taken with Mr. Maxey, Mr. England, Mr. Smith, Mr. Bosch, Mr. Nicholas, Mayor Postage, and Mr. Sabatino voting “Yea.” Motion passed, 7-0.
F. Review and request for motion to
approve commercial design guidelines certificate of appropriateness for
building materials for Cottman Transmission at 860
Refugee Road. Mr. Schultz stated the
site plan appears to meet all building and parking setback requirements and
there appears to be sufficient space to accommodate the interior and perimeter
landscaping requirements. He further
stated the north elevation of the building would front Refugee Road and be
comprised of two bays of windows with the main entrance door surrounded by
brick veneer that matches CVS Pharmacy.
He stated the canopy with signage would be located on the western
portion of the elevation, the south elevation would be comprised of brick
veneer with a metal door that serves as a fire exit, and the east elevation
would be comprised of five steel overhead doors surrounded by brick
veneer. Mr. Schultz stated the office
area would be comprised of brick veneer with two bays of windows and a canopy
with signage. Mr. Schultz stated staff
felt the sign canopy should be eliminated and replaced with brick veneer as it
does not match the adjacent buildings.
He stated the building signage letters should be attached directly to
the building like the CVS Pharmacy, Auto Zone, Below Clearance, and Munroe
Muffler. Mr. Schultz stated the windows
should not extend to the ground, there should be three to four feet of brick
before the windows are installed and the windows should be divided into smaller
sections with muttons and mullions. Mr.
Schultz stated the owner was proposing a pitched roof with shingles and the
shingles should match the color of the roof on the CVS Pharmacy. Mr. Schultz stated staff supported the
certificate of appropriateness for building materials with the conditions that
the color of the brick and the color of the roof shingles match the CVS
building, that the sign canopy be eliminated and replaced with brick veneer,
that the windows be divided into smaller sections with muttons and mullions,
and that the dumpster be enclosed and screened from the adjacent
properties. Mr. Sabatino
clarified that a further condition would be that the windows do not go to the
ground. Mr. Schultz stated that was
correct, and he had spoken to the architect and it was indicated they had no
problem with the bricks going higher and eliminating the signage. Mr. Schultz stated the applicant was to bring
revised drawings this evening, but that did not occur. Mr. England stated a letter provided to the
Commission indicated they would match the brick on the CVS Pharmacy. Mr. Schultz stated that letter was written
prior to his conversations with the architect.
Mr. Sabatino clarified the applicant was aware
of the conditions Mr. Schultz had just stated.
Mr. Nicholas stated he had concerns on the site plan as two parking
spaces next to the building might cause a problem and he would recommend these
spaces be moved to the west to create a buffer that would protect the
building. Mr. Nicholas further stated
there are 12 spaces to the rear of the building and he felt the nine foot
setback on the pavement met the code, but perhaps those 12 spaces could be
shifted to the west to align with the 15 foot setback of the building. Mr. Nicholas stated he agreed with the
requirement for muttons and mullions, however, he felt the canopy would be a
nice accent. Mr. Schultz stated the
canopy is attached to the brick and he understood the canopy would be a
different color than the brick. Mr.
Nicholas stated he would like a clarification on the E.F.I.S. they were
proposing, and he would recommend the storefront grade match the height off of
grade on the right elevation. He further stated it was not shown, but he would
recommend frieze boards be put in to trim out. Mr. Nicholas stated he just felt
it was a very plain building and needed some additional décor. Mr. Maxey stated he concurred it was a very
plain building and Mr. Bosch stated he felt the fascia brick should be used for
some type of separation from the roof.
Mr. Schultz stated he did not feel this had been thought through by the
applicant as it had originally come in with a flat roof and he had indicated we
would need a pitched roof. Mr. Schultz
stated these were the drawings that had come in and he did not know if they had
had time to address the issues being discussed here. Mr. Schultz clarified the Commission could
approve the site plan of the building location and review the building
materials at the next meeting. Mr. Mapes stated that could be done to allow the applicant to
start working on the foundation and that type of thing. Mr. Sabatino stated
prior to making a decision he would like to have some discussion from the
applicant on the building materials. Mr.
Nicholas stated he would also like to know the colors the applicant was
planning on using. Mr. Nicholas moved
to approve the location of the building as shown on the site plan, but to Table
all the other issues for the next meeting; Mr. Sabatino
seconded the motion. Roll call was
taken with Mr. Sabatino, Mr. Bosch, Mr. Nicholas, Mr.
Maxey, Mr. England, Mr. Smith, and Mayor Postage voting “Yea.” Motion passed, 7-0. (TABLE, 01-14-03)
E. Review and request for motion to approve revisions to the city’s codified ordinance to roadway standards in multi-family developments, to require sidewalks in multi-family developments, identifying setback requirements in multi-family developments, and other pertinent revisions. Mr. Schultz stated some of the highlights in this revision dealt with the streets in multi-family developments. He stated the purpose is to make those public streets, that the curbs and gutters be full 18-inch curbs, and in commercial or industrial developments the city will determine if driveways are public streets or private streets and also if the curbs should be 18-inch or extruded curbs. Mr. Schultz further stated this would ensure sidewalks be located within multi-family developments where staff or the Planning and Zoning Commission determines they are necessary. He stated it would also reduce the width of driveways in multi-family developments where there is a garage or opening from 24 feet to 16 feet. He also stated this would ensure that perimeter mounding and fencing would be maintained by the homeowner’s association or the owner of a multi-family development, and they would be responsible for replacing the fencing and landscaping in the future. Mr. Schultz further stated the revision contained clarification of definitions to ensure they comply with the requirements. He stated further the setbacks in condominium developments would be reduced from 30 to 25 feet as that is more consistent with two or three family row housing setbacks. Mr. Bosch moved to approve the draft ordinance; Mr. Nicholas seconded the motion. Mr. Bosch stated he would like to thank staff and the law director for the work that went into this legislation. Roll call was taken with Mr. Nicholas, Mr. England, Mayor Postage, Mr. Maxey, Mr. Sabatino, Mr. Bosch, and Mr. Smith voting “Yea.” Motion passed, 7-0.
4. REPORTS:
A. Planning and Zoning Director - Lance Schultz
(1) BZA Report. Mr. Schultz stated the Board had one case last month and had approved a storage building variance. He further stated there are no cases scheduled for this month.
B. FCRPC - Lance Schultz. Mr. Schultz stated the Commission approved a preliminary plan for Sycamore Plaza on Refugee Road, which is the Kroger and other commercial establishments across from the new high school. He stated they also approved a plan by TrevCor Development on the north side of Busey Road for an outside storage facility that would front on Route 33.
5. OTHER BUSINESS: No other business was brought forward.
A. Tree Commission. No report.
6. ADJOURNMENT. There being nothing further, Mr. Nicholas moved to adjourn; Mr. Smith seconded the motion. Mr. Bosch, Mr. Maxey, Mr. Smith, Mr. Sabatino, Mr. England, Mr. Nicholas, and Mayor Postage voted “Aye.” Motion carried, 7-0. The Planning and Zoning Commission adjourned at 8:05 P.M., January 14, 2003.
