1. ROLL CALL. Mrs. Riggs called the work session to order at 6:30 P.M., with Mrs. Riggs, Mr. O’Brien, Mr. Wright, Mr. Hackworth, Mr. Parker, Mr. Sabatino, and Mr. Wisniewski present. Mayor Shaver arrived at 6:45 P.M. Others present were: Judy Gilleland, Lynda Yartin, Jennifer Readler, Phil Hartmann, Jerry Dailey, Lance Schultz, Paul Lane, Jennifer Frommer, Linda Fersch, Susan Crotty, and others.
2. Review and discussion of pre-annexation agreements for the 362 acre annexation, 316 acre annexation, and 387 acre annexation. Ms Gilleland stated this work session was to review the pre-annexation agreements on the three pending annexation issues. She stated although most Council members had received copies of these agreements in the past, she felt it would be beneficial to have a complete review now so any questions could be answered and everyone was aware of what the City was required to do.
Mr. Hartmann stated their goal was to provide Council with a background and go through any terms that were not understood or there were questions on. He stated they did not want to discuss issues relating to pending litigation, and if that comes up Council can go into Executive Session at some point. He stated the 316 acre annexation is currently scheduled for a hearing on February 3, 2005, before the Court of Common Pleas in Fairfield County. He further stated the 387 acre annexation is on hold while the two pending appeals that related to the Thornton case and Canal Winchester are heard on the 10th in the Court of Appeals.
Jennifer Readler stated all of Council had been provided a memorandum dated January 17, 2005, in which the various pre-annexation agreements were broken down according to the separate annexations. She stated she would review the main obligations of both parties for all of the agreements, and if anyone had any questions she would be happy to answer them.
Ms Readler reviewed City and property owner obligations in the pre-annexation agreements for the 316 acre annexation (John and Barbara Donley, 8185 Farms, Janice L. Craig and Sheridan Smith); the 387 acre annexation (Winchester Trace II Development, Alyce Lucille Thornton, Trevcor Development, Gregory Bigus, Weiser Development, Polly Weiser, and Kevin Weiser); and, the 362 acre annexation (Dominion Homes, Ebright, Gillian Family Limited Partnership, Sycamore Creek Community Church, Leonard Real Estate, and Virginia Homes). Ms Readler stated should any Council member have any questions, if they would contact her and she would be happy to provide any information.
3. ADJOURNMENT: There being nothing further, Mayor Shaver closed the work session at 7:20 P.M., January 18, 2005.
