CITIZEN’S TASK FORCE FOR PROPERTY MAINTENANCE

REGULAR MEETING

6:30 P.M.

 

1.         ROLL CALL.  Mr. Smith called the meeting to order with roll call as follows:  Mr. Smith, Mr. Barletta, Ms Goodrich, Ms Carter and Dr. Henry were present.  Mr. King, Mr. Sells, Mr. Bowen, Mr. Walburn and Ms Trout were absent.  Others present were:  Lance Schultz, Lori Aberman, George Parsley, Rachel Ellis, Stephanie Griffith, and Jonathan Leslie.

 

2.         APPROVAL OF MINUTES OF February 3, 2005, Task Force Meeting.  Ms. Carter moved to approve; Ms. Goodrich seconded the motion.  There being no discussion Ms. Goodrich, Dr. Henry, Mr. Smith, Mr. Barletta and Ms. Carter voted “Aye.”  Motion passed, 5-0.

 

3.         SCHEDULED MATTERS:

 

            A.        Review of On-Street Parking Research by Task Force Members.  Mr. Schultz stated last month the Task Force requested that he obtain some legal opinions from the law director regarding on-street parking on public streets.  The law director stated the City could restrict parking on public streets in subdivisions if there is a health or safety reason.  The law director also research case law on municipal regulations restricting the number of cars on a street based on the number of licensed drivers per dwelling unit.  She could not find any case law using that restriction.  Mr. Schultz stated the law director stated that would also be very tough to enforce.  The law director suggested distributing parking permits to residents in the subdivision, this would make it easier to enforce.  Mr. Schultz stated he included an application regarding tractor-trailer parking permits in residentially zoned areas.  This application would need to be completed and submitted to the Chief of Police.  The Chief of Police will determine whether the application is appropriate based complying with the checklist provided on the application.  The tractor-trailer parking permit is good for one-year and would have to be renewed annually.  Mr. Smith inquired how many of these applications have been approved and on the books for this year.  Mr. Schultz stated he would have to check with the Chief of Police on that.  Dr. Henry clarified the recommendation is that they should issuing parking permits.  Mr. Schultz stated that is what is being recommended.  Mr. Smith stated he felt that would be a great burden on whatever department was in charge of issuing the permits.  Mr. Schultz stated the Police Department would be in charge of issuing the permits and enforcement of them.  Ms Carter stated she felt one of the reasons why this was even brought up was when people have large parties and they block their neighbors from being able to use their own driveways and access to their own homes.  Mr. Schultz stated he feels it would be better this was looked at by a case-by-case scenario and just leave everything as it is.  Ms Carter stated she feels they should just

leave this alone.  Mr. Smith stated as a resident he does not want to have to bother with getting a parking permit every year.  Mr. Schultz stated if they did issue parking permits it would cost the City to provide that service.  Mr. Smith stated he also does not think that would be a good use of the Police Department staff.  The Task Force Committee agreed to remove the language in section 452.13 “Maximum Consecutive Hours For Street Parking” paragraph (b) from the City code.  Mr. Smith stated this is something that needs to be handled on a case-by-case basis.  He continued is there a provision in the code for parking permits for certain areas.  Mr. Schultz stated he would have to check into that.  Ms Carter stated she feels if that is in the code it should just be removed instead of revised.  Mr. Smith stated the Committee wants to eliminate any reference to limiting the number of vehicles parked on the street.  Ms. Carter stated Section 452.03 part 7 of the code doesn’t state that is thirty feet from an intersection.  She continued that she would like to add “within thirty feet from a traffic control device, stop sign or from an intersection as well.” Mr. Smith inquired of Mr. Schultz to obtain the true definition of a crosswalk and do they have to be painted on the ground where they are located.  Mr. Smith stated they need to strike item 5 “at an intersection,” and add “at an intersection” in part 7. 

 

            Ms Carter stated she is concerned with Section 452.05.  Did the law director have any input regarding that section?  This section actually says that you cannot do anything about it for four hours.  Mr. Schultz stated the City code supercedes the Ohio Revised Code.  Ms Carter stated she is aware of that, however, the City code states the same thing that the Ohio Revised Code states.  Mr. Parsley stated if they want to change that section they can.  Mr. Schultz stated he did not discuss that section with the law director.  Mr. Schultz stated the definition of a crosswalk is in Section 402.12 (b).   Dr. Henry stated he felt they should really look-in to modifying the definition of a “crosswalk.”  Mr. Smith stated Dr. Henry could work on the appropriate wording of that definition and then forward his suggestions to Ms Carter and the Task Force could work on that at a future meeting.  Mr. Smith stated he would like a Police Officer to be present at next month’s meeting to answer any questions the Task Force has regarding on-street parking.  Mr. Schultz stated he would make sure a Police Officer would be present at next month’s meeting.  Dr. Henry stated he feels they need to address bike paths in regards to the crosswalk issue as well.  Mr. Parsley stated he emailed Sergeant Annis who went out to the intersection that Ms Trout was concerned about.  He continued that he asked the Police Officer if this was an unmarked crosswalk area and the Police Department stated they did not see a safety issue at that location, however, they would monitor it.  Mr. Smith asked Dr. Henry to forward his suggestions for the definitions to Ms Carter.  Dr. Henry inquired do they want to do that prior to the Police Officer attending next month’s meeting.  Mr. Smith stated he should do that now and the definitions can always be modified.

            B.         Review of Draft Off-Street Parking Recommendations by Task Force Members.   Mr. Smith inquired of Mr. Schultz as to whether the law director had any questions or comments regarding off-street parking.  Mr. Schultz stated he did not discuss that with the law director.  Mr. Smith stated they are talking about Section 1290.02.  He continued that Ms Carter’s suggestion has passed the informal legal hurdle.  This section deals with parking on your property.  Ms Carter stated she added the part about junk or abandon vehicles on your property because it has been added in other communities and she felt it was something that needed to be addressed in Pickerington.  The Task Force reviewed all of the suggestions made by Ms Carter.  The Task Force also discussed side yard parking. Ms Goodrich stated she would like some time to research the issues the Task Force has regarding side yard parking and will forward that information to Ms Carter prior to next month’s meeting.  Mr. Smith stated all the Task Force has to forward on to Safety is the Home Occupation recommendations.         

 

C.                 Review of House Maintenance Standards by Task Force Members.  Mr.

Smith stated he would like to discuss the following items at the next meeting. 

 

(1)               Structural Damage

 

(2)               Paint

 

(3)               Roofs

 

(4)               Fences

 

(5)               Landscape Weeds

 

 

4.         OTHER BUSINESS. No other business was brought forward.

 

5.         ADJOURNMENT.  There being nothing further, Ms Goodrich moved to adjourn; Ms Carter seconded the motion.  Mr. Smith, Mr. Smith, Ms Goodrich, Ms Carter and Dr. Henry voted “Aye.” Motion passed, 5-0.  The Property Maintenance Task Force adjourned at 8:08 P.M., March 3, 2005.
